CLE: Recent Developments in Administrative Law for the Communications Industry

The FCBA Judicial Committee will sponsor a CLE on Wednesday, February 8 from 12:00 – 2:00 p.m. ET entitled Recent Developments in Administrative Law for the Communications Industry.  This program will be held virtually via the Zoom platform.

The FCBA will apply for 2.0 hours of MCLE credit from the VA Bar.  This program has not yet been approved.

12:05 – 1:00 p.m.       Procedural Injuries and Standing in Communications Consumer Protection Litigation
Since the Supreme Court’s 2016 decision in Spokeo, Inc. v. Robins, plaintiffs alleging “procedural” violations of federal consumer protection statutes have faced an increasingly steep burden to demonstrate a concrete injury, as required to establish standing and invoke the federal courts’ jurisdiction under Article III.  The panel will discuss the latest developments in the Spokeo doctrine, including the Court’s June 2021 decision in TransUnion v. Ramirez, the circuit split over the application of Spokeo to certain claims under the Telephone Consumer Protection Act, and other issues and trends.

1:00 – 2:00 p.m.         Potential Consequences of West Virginia v. EPA and the Major Questions Doctrine for FCC decisions
Last June, the Supreme Court held that in “extraordinary cases” a federal agency must point to “clear congressional authorization” for the authority it claims.  The panel will address the background to and potential ramifications of this “major questions doctrine” for challenges to FCC decisions.
