The FCBA Enforcement and Homeland Security and Emergency Communications Committees will sponsor a CLE on Monday, March 17, 2:00 – 4:00 p.m. ET entitled The FCC’s Outage Reporting Regime: A Review of Enforcement and Compliance Challenges. The program will be held virtually via the Zoom platform.
The FCC’s Part 4 rules require communications providers to report significant degradations in network functions to the FCC, as well as potentially affected 911 and 988 special facilities. These reports are intended to enable the FCC and other authorized entities to understand the magnitude of major outages, identify trends, and promote network reliability best practices that can prevent or mitigate future disruptions. In recent years, outage reports have become the basis for FCC enforcement actions that require communications providers to justify the reasonableness of their network designs and operating procedures and, typically, result in multi-million dollar penalties. Further, new rules are raising concerns about the compliance burden on providers and unintended consequences for 911 and 988 special facilities. This CLE will review the FCC’s new rules, the Enforcement Bureau’s related investigations and actions, and compliance challenges and potential solutions for communications providers and 911/988 special facilities.
The FCBA will apply for 2.0 hours of MCLE credit from the VA Bar. This program has not yet been approved.
