The FCBA Wireline Committee will sponsor a CLE on Tuesday, December 10, 1:00 – 3:00 p.m. ET entitled The Future of Universal Service: Next Steps in Consumers’ Research v. FCC. This program will be held virtually via the Zoom platform.
The FCC’s Universal Service Fund faces scrutiny as the U.S. Supreme Court will consider challenges to its constitutionality following a series of cases brought by Consumers’ Research. Earlier this year, the Fifth Circuit ruled en banc that the combination of the USF’s statutory structure and its administration violates the non-delegation doctrine, while the Sixth and Eleventh Circuit Courts of Appeals issued opinions upholding the program’s constitutionality.
The first panel will review the status of the Consumers’ Research cases and legal challenges to the Universal Service program. The second panel will discuss the implications of the case from a policy perspective.
The FCBA will apply for 2.0 hours of MCLE credit from the VA Bar. This program has not yet been approved.
